Financial Reports - MVF The Financial Report - Follow the Money!

What do you think really happened?

According to written reports it took 460 days to discover that MVF cash funds under the care, control and custody of MVF staff were missing, misdirected, stolen and or embezzled. The event was first publicly reported by the embattled staff writer of The Gazette Sebastian Montes in its February 7, 2007 edition that a police warrant of a former MVF employee accused of fraudulently authorizing transfer of $13,684 from MVF retirement fund. Seven (7) months latter in the February 16, 2007 issue of the Village News , The Official Newsletter of Montgomery Village Foundation, Inc., reported that the “Employee theft was shocking, but audit and internal investigations averted financial loss, …the financials are clean and No funds will be lost and MVF retirement accounts and all other foundation accounts are in order” (Lois Campbell, Interim Treasurer); “Arrangements have been made to recover all of the funds, plus interest.(Keith Silliman, Interim MVF President) and “…the auditors, local police and Board of Director have worked together to make everything right”. (Pat Huson, Interim EVP). Everyone has questions but as Pat Huson, Interim EVP stated in response to Marilyn A. Cadoff, a CPA and a resident of The Points in her questions on the embezzlement “The staff is excellent, details of the loss will not be given since the case is not yet entirely closed and Ms. Cadoff can go apply for membership on the MVF Audit Committee.” Let’s list the questions and speculate about the answer.

How and who discovered this unauthorized transfer? Why did it take so long to discover that MVF funds were fraudulently transferred and take action after the discovery?
What and who knew and when did they know it?
What can we say about MVF’s financial management systems and practices?
What can we say about MVF’s Board of Directors oversight and communications of financial matters?

The “gap” between discovery and resolution

On July 11, 2006 (Day 460) the Gazette reported John R. Zakian alerted police to “the suspicious transfer, according to police reports”. How long before Zakian was aware of the situation? Heaven knows, John was a promoter and public relations type and didn’t have the skills or desire to supervise a petty cash account let along be in charge and take responsibility for a community with $ 9 million in assets and a $6 million budget. As Sebastian Montes, the “annoying” staff writer for the Gazette, wrote on August 2, 2006 Day 481, that soon after Zakian left his job as executive director of the Yonkers (N.Y.) Industrial Development Agency/Job Development Corporation (1984 to 1993) his secretary at Yonkers was accused of embezzling $350,000 and pleaded guilty to a lesser charges. Zakian told the Gazette he was the one who realized his secretary had written checks to herself and said he was unfairly blamed for failing to discover the embezzlement, which should have been uncovered in an audit. We could give John credit for “Embezzlement Reduction”, as embezzlements under his watch declined from $350,000 to $13,000 but I don’t think he uncovered the theft, he only provided the environment that encouraged such things to happen.

Not withstanding Pat’s Huson’s comments above about “details about the loss will not be given”, as reported in the Village News President’s Message column “The discrepancy was noted approximately a year later during the 2005 Audit” in April of 2006. That would mean a “gap” of at least 81 days between the “notation” of the discovery by the auditors and when Zakian “alerted police to the suspicious transfer”.

This only increases the quantity of unanswered questions about handling and condition of the financial and fiscal affairs of the Foundation as well as the creditability of those with power, duty and obligation in such matters.

  1. As a former employee of the Foundation, I can assure you that the Buttry situation was kept very quiet. I am guessing that only three MVF employees even knew about it once the auditors allerted them, and one, of course, was Zakian.

    Google Zakian once in a while, and you'll see that his history at the Foundation and in a previous job are already beginning to haunt his career. He was appointed to a fairly prominent position in New Bedford, MA, where his wife lives. He withdrew from the appointment in January when the Buttry story came out.

    The reporters from Yonkers and West Palm Beach are being updated as I hear things. I worked for John, and it was no picnic. Please don't hold the staff accountable for his ego and the problems he caused. For fear of losing our jobs, directors and staff did the best we could. I left for health and family reasons, but loved the dedicated people who continue to serve the Village.

  3. I am a former MVF employee. Zakian was a monster. That does not excuse the MVF board for letting him happen along with the money mess. He was thrown out of every job he had. Lon Haman, Keith Silliman, Dick Wright and the rest of that board are responsible for everything bad that has happened in Montgomery Village.

  6. With the elections over, I’ll take a wait and see approach for a little while. Hopefully the 3 new board members recently elected to the board can start the process of cleaning up. My biggest concern isn’t the small amount of money pilfered from the retirement funds, it’s the lack of direction the previous board had in creating a balanced budget that wouldn’t eat into the reserves that we have built up. Loosing 100’s of thousands of dollars a year, what can we say but WOW!

Sick of deficit: You are correct, based the annual audits published in the MVF Annual Reports, even though "Contributions to Reserve Funds" is included in each year's budget and collected as part of the assessments paid, the actual cash payments to the reserve investment funds were $445,766 (2004), $498,144 (2005) and $000. (2006). The MV Observer will discuss, Audits - "Clean is not clear, good or a reason for forgiveness" and more on reserves in April.

    Embezzling in Maryland, under Zakian's watch

    You all remember John Zakian, the city's former executive director of the New Bedford Economic Development Council?

    The last job he had was with the Montgomery Village Foundation in Maryland, where he was the executive vice president.

    Apparently, one of his employees was caught embezzling nearly $100,000. A similar thing happened when he was in charge of a redevelopment group in Yonkers, N.Y.

    The story does not mention Zakian, but he was there until the summer of 2006, when this embezzling took place.

  18. The Foundation is the center of governance for the Village. The Foundation, together with the homes corporations and condominiums which are separate entities in terms of governance and responsibility, oversee the health, safety and welfare of the entire community.

    BOGUS STATEMENT! In approximately 20 out of 27 years of contacting you or calling upon your assistance regarding the deterioration and degradation of Nathan's Hill (with my understanding that the word Foundation itself meant you were the hierarchy who, in long run, was overseer of ALL communities in Montgomery Village particularly when South Village Homes Corporations continued to be seemingly absent and neglectful in their responsibilities), MVF's standard line was "It's not my job. Contact your Homes Corporation". Or, when I for years witnessed and stated Nathan's Hill was going to 'hell in a handbag', the line was (particularly from Richard Wright) "we take care of the lakes, pools and tennis courts".

    By the way, I can not contact my socalled Representatives. They barricade themselves with a middle man, The Management Group Association Inc. Can't penetrate that 'protective fortress' around South Village Homes Corporation and its (misnomer) Representatives.

    Ironic there too 'cause it was MVF who aggressively exterminated Lake Whetstone without exterminating our community as well. Ergo, your CARE for us was to literally infest US with rats that ran in 'packs' for over three months!! Yep, Mr. Wright, you took care of YOUR lake all right with absolutely no regard or forethought for us!

    {There are certain folks still on the Foundation Board who should have been 'grandfathered' out of there years ago.}

    MVF's response, attitude or even non-response to my 'desperate alerts' was 'so what if Nathan's Hill was becoming a landfill ghetto'!!!! Living in a ghetto has never been and is not my idea of an 'amenity' particularly when I have been paying assessment (Homeowners) fees for 26 years to prevent (with your promise to me at my time of purchase in 1981) such from occurring!

    (20 out of 27 years this August of calling upon MVF to no avail leaves little room for 'sweet, positive taste in my mouth' as stated or flowery encouraged by you in your fictional last paragraph of your editorial.)

  20. Mr. Perley of Whetstone Homes Corporation, Mr. Brandt of Patton Ridge Homes Corporation,
    Mr. Gronsky of Stedwick Homes Corporation, Ms.O'Grady of East Village Homes Corporation,
    Mr. Mondell of the audit committee, sure don't speak for the majority. These people seem not to have read or understood the election results in March. Residents want change, not more of the same ole. I say that the progressive actions by the new MVF board president and the board members supporting Mr. Hydorn are what the true majority in the village want.

    I find it shocking that Mr. Brandt recently used the word "cabal" to describe the new working board for the change village residents voted for. The original "cabal" was on the old board. They had eight months since the departure of Mr. Zakian to form a search committee and hire a new executive vice president. At least the new board is moving the search process ahead. That old "cabal" did nothing but stall.

    I do not want to see a repeat of MVF history that appeals to Mr. Brandt and his new "cabal" that they have now named "The President's Council". Where was the new "cabal's" outrage when the former board lost almost a $1 million of residents' money? Why does the new "cabal" not fault the board that voted for repeated deficit budgets, failed to disclose the embezzlement of MVF funds, had no leadership on the proposed golf course development and then allowed the Zakian boathouse fiasco? The new "cabal" keeps supporting the message from MVF staff "oh everything has been checked and all is safe" as has been said repeatedly in the Village News. Well now there is another $86,000 of our money stolen. At least the new president had the guts to stand up and let the residents know what had happened.

    It appears that a small minority, this new "cabal" want to take the focus off the real problems in the MVF. Now the new "cabal" has begun to lead smear tactics against a more than qualified individual as treasurer.

    It comes down to one question and one question only. What is the new "cabal" trying to hide?

  22. Residents need to turn out at the MVF meetings and demand to know about their money. Force the MVF to order an outside audit, that staff at the MVF can not audit themselves. I don't care how good they think they might are. They are not qualified certified public accounts.

  24. Really good letter in today's Gazette. This guy gets it:

    Headline: Stop whitewashing truth over embezzlement

    Letter: Let me get this straight: The Montgomery Village Foundation was alerted to an initial embezzlement that was only brought to public attention because of The Gazette.

    The former MVF board of directors had cut a deal with the person responsible to repay the money without investigating if more was missing. Now, according to police, at least $100,000 in embezzlement has been discovered only because the MVF was tipped by a former lifeguard. Otherwise, the MVF board and staff was telling us all that everything was fine.

    Now, a very small group of disgruntled residents wants to reinstall a certain individual as MVF interim treasurer who was the interim treasurer when much of the embezzlement occurred. There is something very wrong with this picture.

    We do not need anyone as MVF treasurer who is in anyway associated with the large MVF deficits or the current effort to tell residents all is well. Let’s get a financial competent who will not whitewash the truth or favor deficits. This is our money.

  25. I am a former MVF employee who has posted to this site in the past. For the record, I left of my own accord because I could not stand the place anymore.

    The MVF staff and older board members will attempt to villify anyone who who opposes their restricted viewpoints. They readily ridicule residents and board members behind their backs. No critcism is acceptable to them.

    If Ed Brandt, Michael Gronsky, Linc Perley, Terry O'Grady and others knew how they are mimiced and gossiped about behind their backs, they might have a different view of the MVF staff. How does everyone know about Gronsky's driving "misshaps" and Dr. Aiuto's felony conviction? It all came from MVF staff gossip. ALL of it. They are only nice because those people are customers. Behind their backs, watch out.

    From talking with current staff, the MVF is dysfunctional and morale is at an all time low. Pat Huson is providing no leadership and Lois Campbell is running the place. Several staff people are going to quit.

    Staff is looking to the new board to be their salvation from Lois Campbell. Everyone detests her. She meddles in every department and does no work.

    There are a few good people left at the MVF. I hope the new board will do something quickly to salvage the mess.

  28. I do not waste my time on a regular basis but I did. Sitting in the MVF meeting Thursday night and watching Ms.Campbell lobbying for an assessment ceiling increase of 50%. Yes 50%. Then the board voted 4-2 to send the increase to the MVF reps for their approval. What the hell are they thinking? Hey folks it is our money.

Well we see that the Village Gazette has published private information obviously leaked to the President of Stedwick to get put in the paper by none other than Mr. Reporter and supporter of the MVF staff, Sabestian Montes. Does no one at the MVF understand? All that they are doing is hurting the reputation of the community, lowering our property values, making the place the laughing stock of the county.

    Why doesn't anyone want to see the community a respected place to live. A good investment in which to purchase a home. A friendly place to live.

    Now I know why my house is not selling after 8 months. No one is crazy enough to move here.

  32. Amen to not being able to sell your house. I'm sitting in a neighborhood of "For Sale" signs with nothing moving. Only an idiot would buy here given all the financial troubles. And once they pass the outrageous assessment ceiling increase, no one will want to live here. Unless something changes -- and fast -- I'm afraid we're on the slippery downward slope.

  33. Yesterday's Gazette was outrageous. I hope that guy Gronsky gets sued for slander. Our board should throw him off for putting my community at risk of a lawsuit. I have never seen a business so badly run as the MVF. I suspect the reason a few people do not want any previous employee in to run the MVF is because he/she will discover what a mess the place really is financially. I bet that Campbell woman has screwed up the books really bad. Is it true her boyfriend embezzled federal funds? What IS that MVF board thinking? Now they want more of my money? Forget it. I live in Stedwick and if one person here votes for that increase, I will make it my mission to get out the vote against him/her.

He better not vote to give the MVF any additional money. I echo the call for him to get thrown off the Stedwick board. He is an embarrassment.

  35. Sure looks like everyone is on the same page here, just not the MVF board, staff or people like Brandt, Perley, Gronsky, O'Grady. Are they all in cahoots on this? Raise the assessments, lower the home and condo values, just so you can be in control. There are elections in a few months, guess what folks, your are going to loose if you run again. The assessments in Whetstone are high enough already and the finances are still messed up here.

  36. I live in East Village and just heard about this blog. I think what Terry O'Grady and the EV board did about that fence is criminal. Where does she get off shrieking at the MVF board about anything when she has messed EV up so badly? She needs to be gone before EV gets sued over that fence. Imagine, trespassing on Pepco and North Village property with the fence. If EV votes to give the MVF more money, people will rise up screaming.

  37. O'Grady, Brandt, Gronsky, Perley, Aiuto, Huson and Campbell are making is place look like hell. Costly, devalued, unfriendly, nasty, rude staffed, and the laugh of the area.

    The folks like us who are paying the price for their stupid actions need to revolt. Line people up to take over the boards of East Village, Patton Ridge, Stedwick, and the MVF. Elections are after the first of the year, it is time these boards have new leaders - no one might say have leaders since they don't have leaders now. These idiots can not be called leaders.

    I don't dare give my name, I can see the ARB of MVF finding the world wrong with my house if I did.

  39. To the previous poster: You've forgotten that all of us who live in the Village pay into the MVF Fund, whether or not our communities are managed or maintained by the MVF. What we're concerned about is the gross mismanagement of MVF finances, the continued deficits, the embezzlements and the lack of professionalism in the running of the organization. Taking potshots at people who are trying to resolve these problems isn't productive.

  40. It appears that the MVF board is not running the show. PR, SHC, EVHC somehow got the idea that they run the MVF. I wonder who gave them that idea? Could it be the former Interim Director of Finance? The MVF Board of Directors better take charge now. David Humpton needs the help with fixing the mess and the misconceptions.

I was just elected to the Thomas Choice Gardens Condo board with intentions on cutting costs. Hopefully, I can help make a difference at the MVF Board Level.....thanks for your consideration
